RBI REVAMPS RULES ON OVERSEAS INVESTMENT: THE NEW REGIME

On August 22, 2022, the Government of India through the Ministry of Finance and in consultation with the Reserve Bank of India (“RBI”) notified the Foreign Exchange Management (Overseas Investment) Rules, 2022, Foreign Exchange Management (Overseas Investment) Regulations, 2022, and the Foreign Exchange Management (Overseas Investment) Directions, 2022 (collectively referred to as the “OI Guidelines”). The OI Guidelines have been notified with the purpose of overhauling the existing regulatory framework in relation to overseas investments and acquisition of immovable property outside India.
