HIGH COURT OF DELHI CLARIFIES THE APPLICABILITY OF THE POSH ACT ON DELINQUENT EMPLOYEES FROM OTHER DEPARTMENTS/ORGANIZATIONS

The High Court of Delhi on June 30, 2023, in the case of Dr. Sohail Malik vs. Union of India and Anr., held that in a complaint under the POSH Act where the complainant and the delinquent employee do not have the same employer, the internal committee of the complainant’s workplace can adjudicate the same. It was held that such committee is empowered to forward its recommendations to the employer of the delinquent employee for action.
