The Supreme Court recently upheld the validity of the Employees’ Pension (Amendment) Scheme, 2014, which had introduced certain far-reaching changes in the operation of the Employees’ Pension Scheme, 1995. In its judgment, the court identified the classes of pensioners eligible for the benefits under the amendment and directed the EPFO to issue necessary measures outlining the procedure for eligible pensioners to avail the benefits. Our Employment Law practice group members Sowmya Kumar, Ivana Chatterjee and Animay Singh analyse the key highlights of the judgment and the subsequent EPFO circulars.
